Recovery Culture Assumption of Risk and Waiver of Liability Agreement
PLEASE READ CAREFULLY – THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS
This document is a legal agreement. Before signing it, please seek independent legal advice or assistance if you are unsure of its purpose or consequences.
In consideration for being allowed to use the Equipment and/or participate in the Protocols offered by Recovery Culture, I hereby acknowledge and agree to the following terms:
Definitions:
In this agreement:
Equipment refers to any equipment owned, operated, or utilized by Recovery Culture and may include saunas, cold pools, hot pools, compression garments, theraguns, red light therapy or any other equipment.
Protocols refer to any protocol offered by Recovery Culture that utilizes the Equipment.
Acknowledgment of Risks:
1. I understand and acknowledge that the use of the Equipment and/or participation in the Protocols exposes me to extreme and sudden changes in conditions, environments, equipment, facilities, and surroundings. These may include, but are not limited to, exposure to cold or hot temperatures, confined spaces, wet areas and pools, infrared waves, changes in oxygen levels, pressure application, and restrictions on normal movement.
2. I have read and understood the Risk Warning statement provided above and acknowledge the potential dangers, risks, and hazards associated with my use of the Equipment and/or participation in the Protocols. These risks may result in personal injury or illness, ranging from minor to catastrophic, including pain, headaches, bleeding, infection, anxiety, low or high blood pressure, breathing difficulties, fractures, seizures, heart attacks, strokes, drowning, permanent disability, death, and other physical or mental incapacities.
3. I acknowledge that my use of the Equipment and/or participation in the Protocols is for recreational or leisure purposes and that it involves a significant degree of risk of physical and mental harm, as well as obvious risks.
4. I understand that using the Equipment and/or participating in the Protocols may involve group activities with other individuals, and [Wellness Center Name] is not liable for the actions of any other participants or third parties. 6. I voluntarily assume all risks associated with my use of the Equipment and/or participation in the Protocols and agree to do so entirely at my own risk.
Participant's Health, Fitness, and Physical Abilities:
5. I acknowledge that Recovery Culture has not conducted any assessment of my health, fitness, or personal abilities to participate in the Protocols. It is my sole responsibility to ensure that I possess an appropriate level of health, fitness, physical skills, and personal ability to use the Equipment and/or participate in the Protocols.
6. I am aware that Recovery Culture strongly recommends individuals with medical conditions, impairments, pregnancy, or any condition that may affect their safety during the use of the Equipment and/or participation in the Protocols to refrain from doing so.
7. I acknowledge the strong recommendation by Recovery Culture for all individuals to consult a qualified medical professional before using the Equipment and/or participating in the Protocols.
8. I confirm that I have no medical conditions or impairments, whether physical, mental, or otherwise, that may compromise the safety of myself or others while using the Equipment and/or participating in the Protocols.
9. Should I encounter any difficulties during my use of the Equipment and/or participation in the Protocols, I will immediately cease such activities and seek help, assistance, and appropriate advice.
Compliance with Directions and Rules:
10. I agree to comply with all lawful and reasonable directions given by Recovery Culture's staff, whether oral or written, which includes any rules and directions posted on signs within the facility. I understand and agree not to engage in any illegal, sexual, or disrespectful activities at Recovery Culture and that I am responsible for my actions and choices.
Waiver of Claim:
11. I release Recovery Culture from all liability for any loss (including financial loss), damage, personal injury (physical or mental), death, or property damage that may arise from or be connected to my use of the Equipment and/or participation in the Protocols.
Indemnity:
12. I agree to indemnify and hold Recovery Culture harmless from any and all liability, costs (including legal costs), claims, damages, demands, and actions resulting from or arising out of any incident connected to my use of the Equipment and/or participation in the Protocols. This indemnity does not apply to incidents caused by the unlawful or grossly negligent acts of Recovery Culture.
Release:
13. By signing this agreement, I forever release Recovery Culture from any claims, losses, damages, personal injuries (physical or mental), deaths, or property damages arising from my use of the Equipment and/or participation in the Protocols.
Entire Agreement and Severability:
14. I acknowledge that this agreement constitutes the entire agreement between myself and Recovery Culture and supersedes any prior oral or written representations or statements. If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
Successors and Assigns:
15. This agreement is binding upon myself and Recovery Culture and their respective successors and permitted assigns.
By signing below, I acknowledge that I have carefully read, understood, and voluntarily accepted the terms and conditions of this Assumption of Risk and Waiver of Liability Agreement.
Cancellation Policy
We understand that plans change, and sometimes it is necessary to cancel or reschedule appointments at Recovery Culture. To ensure fairness and efficiency, we have established the following cancellation policy:
Individual Appointments:
To cancel or reschedule an individual appointment, we require a minimum notice of [2 hours prior to your session]. Please notify us by phone or email. Members receive 2 fee free exemptions before charges will be discussed. Warnings will be given when exemptions are used and appropriate issues will be honored.
If you fail to provide the minimum notice period or do not show up for your scheduled appointment, Recovery Culture reserves the right to charge a late cancellation fee of [zero refund for session purchased] or in case of memberships one credit deducted minus exemptions limit. In the absence of a membership 35$ will be deducted to cover the costs of the session.
Group Bookings and Events:
For group bookings or events, including classes, workshops, or retreats, specific cancellation policies may apply. These policies will be communicated at the time of booking or registration.
Late Arrival:
We kindly request that you arrive on time for your scheduled appointment. If you arrive late, your appointment time may be shortened to accommodate subsequent appointments.
In the event that you are excessively late (beyond a reasonable period), Recovery Culture reserves the right to cancel your appointment and charge a cancellation fee, if applicable.
Refunds:
If you have made a payment for a service or event that you wish to cancel within our designated notice period, we will provide a refund in accordance with our refund policy, which may include deducting any applicable cancellation fees.
Unforeseen Circumstances:
In certain cases of unforeseen circumstances, such as severe weather conditions, natural disasters, or circumstances beyond our control, Recovery Culture may need to cancel or reschedule appointments, classes, or events. In such cases, we will make reasonable efforts to notify affected individuals and provide alternative options or refunds.
Please note that this cancellation policy ensures fairness to both our valued clients and Recovery Culture. By scheduling an appointment or booking a service or event, you acknowledge and accept the terms of this policy.

To redeem a gift certificate or voucher, the recipient must comply with any specific terms and conditions associated with the certificate or voucher.
Refunds and Returns:

Terms and Conditions
Please carefully read the following terms and conditions before using the services or participating in the activities provided by Recovery Culture. These Terms govern your use of Recovery Culture's facilities, equipment, products, and services, as well as any participation in classes, workshops, events, or protocols offered.
Health and Safety: a. You acknowledge and understand that participation in any activities or use of facilities at Recovery Culture involves inherent risks. You agree to assume all risks associated with your participation, including potential injuries or accidents. b. It is your responsibility to inform Recovery Culture of any pre-existing conditions, injuries, or health concerns that may affect your ability to safely engage in activities or use facilities. c. You agree to follow all posted rules, guidelines, and instructions provided by Recovery Culture's staff for your own safety and the safety of others. d. If you experience any discomfort, pain, or abnormal symptoms during your participation, you agree to immediately inform Recovery Culture's staff and seek appropriate medical attention if necessary.
Age Restrictions: a. Some activities or services provided by Recovery Culture may have age restrictions or require parental/guardian consent for participants under a certain age. You agree to comply with any age restrictions and assume responsibility for ensuring compliance for any minors under your care.
Conduct and Etiquette: a. You agree to conduct yourself in a respectful, responsible, and courteous manner while on the premises of Recovery Culture. Any disruptive or inappropriate behavior may result in immediate termination of your access to facilities and services. b. Photography, video, or audio recording is allowed only with the explicit permission of Recovery Culture's staff and other participants who may be involved.
Privacy and Data Protection: a. Recovery Culture respects your privacy and handles personal information in accordance with applicable data protection laws. Please refer to Recovery Culture's Privacy Policy for more information on how your personal data is collected, stored, and processed.
Intellectual Property: a. All intellectual property rights, including copyrights, trademarks, and trade names associated with Recovery Culture's services, designs, logos, and materials, are owned by or licensed to Recovery Culture. You agree not to reproduce, distribute, or use any intellectual property without obtaining prior written permission from us.
Limitation of Liability: a. To the extent permitted by law, Recovery Culture shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or in connection with your use of our facilities, services, or participation in activities. Modification and Termination: Please refer to Recovery Culture’s Cancellation Policy for more information about how we deal with cancellation or reschedule of appointments, late arrival or refunds.
Governing Law and Jurisdiction: a. These Terms are governed by and interpreted in accordance with law in the State of Queensland of the Mount Isa shire jurisdiction where Recovery Culture Pty Ltd at Shop 8/27 miles street Mount Isa city 4825 is located. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
By using our services, facilities, or participating in the activities provided, you acknowledge that you have read, understood, and agreed to be bound by these Terms and any additional rules or policies set by Recovery Culture.
